These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Tenant,” “Resident,” “you,” or “your”) and 275 Carling Ave. LP, operating as The Clemow, a subsidiary of KTS Properties Ontario (Business Identification Number: 1000812723) (“we,” “us,” “our,” or “The Clemow”). By accessing or using our website at theclemow.com, scheduling a visit, submitting an inquiry, or entering into a rental agreement with The Clemow, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. About The Clemow

The Clemow is a premium 50+ rental apartment community located at 275 Carling Avenue, in Ottawa’s prestigious Glebe District. The Clemow is owned and operated by 275 Carling Ave. LP, a subsidiary of KTS Properties Ontario. Our registered office is located at:

2. Eligibility

The Clemow is a designated 50+ adult living community. To be eligible to lease a unit at The Clemow, at least one occupant of each unit must be fifty (50) years of age or older at the time of lease execution. All prospective tenants must satisfy our standard application and credit review process. We reserve the right to decline any application in accordance with applicable law, including the Ontario Human Rights Code, R.S.O. 1990, c. H.19, and the Residential Tenancies Act, 2006, S.O. 2006, c. 17.

3. Use of the Website

You agree to use the website theclemow.com solely for lawful purposes and in a manner consistent with these Terms. You shall not:

  • Use the website to transmit, distribute, or store material that violates any applicable law or regulation;
  • Engage in any activity that interferes with or disrupts the website’s functionality, servers, or networks;
  • Attempt to gain unauthorized access to any portion of the website, other accounts, computer systems, or networks connected to the website;
  • Use any automated means, including bots, scrapers, or spiders, to access or collect data from the website without our prior written consent; or
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.

4. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, photographs, video, audio, software, and the overall design and layout of the website (collectively, “Content”), is the exclusive property of 275 Carling Ave. LP or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws. The Clemow name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of 275 Carling Ave. LP or its affiliates. You may not use such marks without our prior written permission. No Content may be reproduced, distributed, modified, displayed, performed, or otherwise used without our express prior written consent.

5. Rental Agreements

These Terms do not constitute a lease or rental agreement. Any tenancy at The Clemow is governed exclusively by a separate written Residential Tenancy Agreement executed between you and 275 Carling Ave. LP, in accordance with the Residential Tenancies Act, 2006 (Ontario). In the event of any conflict between these Terms and a signed Residential Tenancy Agreement, the Residential Tenancy Agreement shall prevail with respect to matters relating to the tenancy. Nothing on this website constitutes an offer to lease, and all availability, pricing, and unit specifications are subject to change without notice.

6. Booking and Inquiries

Submitting an inquiry or booking a visit through our website does not create a binding obligation or guarantee the availability of any unit. All inquiries and bookings are subject to confirmation by The Clemow’s management team. We reserve the right to cancel, reschedule, or refuse any booking at our sole discretion, provided such action is taken in compliance with all applicable laws.

7. Pricing and Availability

All rental rates, fees, and unit availability displayed on this website are provided for informational purposes only and are subject to change at any time without prior notice. Final pricing and availability shall be confirmed at the time of lease execution. Promotional rates or incentives, if any, are subject to specific terms and conditions that will be communicated at the time of the offer.

8. Third-Party Links and Services

This website may contain links to third-party websites, applications, or services that are not owned or controlled by The Clemow. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. Your use of any third-party website or service is at your own risk and subject to the terms and conditions of such third-party website or service.

9. Disclaimer of Warranties

THE WEBSITE AND ALL CONTENT, MATERIALS, AND SERVICES PROVIDED ON OR THROUGH THE WEBSITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 275 CARLING AVE. LP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 275 CARLING AVE. LP, KTS PROPERTIES ONTARIO, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE WEBSITE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE WEBSITE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. OUR AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100.00).

11. Indemnification

You agree to indemnify, defend, and hold harmless 275 Carling Ave. LP, KTS Properties Ontario, and their respective officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the website; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of any third party.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the use of the website shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, sitting in the City of Ottawa. Notwithstanding the foregoing, any dispute arising from a Residential Tenancy Agreement shall be resolved in accordance with the Residential Tenancies Act, 2006, and shall be adjudicated by the Landlord and Tenant Board of Ontario, as applicable.

14. Modifications to These Terms

We reserve the right to modify, amend, or update these Terms at any time, in our sole discretion. Any changes will be effective immediately upon posting the revised Terms on this website, with the “Last Updated” date revised accordingly. Your continued use of the website following the posting of revised Terms constitutes your acceptance of such changes. We encourage you to review these Terms periodically.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, and the remaining provisions of these Terms shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any applicable Residential Tenancy Agreement, constitute the entire agreement between you and 275 Carling Ave. LP with respect to the subject matter hereof and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, relating to such subject matter.
